Kevin L. Owen
Partner, Gilbert Employment Law, P.C.
Kevin Owen litigates all phases of complaints of employment discrimination and appeals of disciplinary action involving federal employees in administrative forums, primarily before the Equal Employment Opportunity Commission and Merit Systems Protection Board, for Gilbert Employment Law. He also litigates in federal district court and has argued appellate issues on MSPB matters before the U.S. Court of Appeals for the Federal Circuit. Mr. Owen regularly represents federal agencies in litigation before the MSPB, including the United States Forest Service, the Natural Resources Conservation Service, Food Safety and Inspection Service, Rural Development Service, Court Services and Offender Supervision Agency, and the National Council on Disability. In addition to representing federal agencies, he also represents senior federal officials in misconduct investigations conducted by the Office of Inspector General, Office of Professional Responsibility, or Office of Special Counsel. Mr. Owen further represents these clients, if necessary, in responding to any potential disciplinary proceedings and appeals to the MSPB. He has prevailed on many appeals before the MSPB, including appeals involving due process issues violations, complex appeals involving a denial of a security clearance, constructive suspension appeals related to disability discrimination claims, and appeals involving reductions in grade for Defense Department employees adversely affected by the National Security Personnel System. He also represents employees who initiate whistleblower and prohibited personnel practices claims before the Office of Special Counsel (OSC) and works regularly with investigating OSC attorneys. Mr. Owen has written several appellate briefs filed in the United States Court of Appeals for the Federal Circuit on cases decided by the MSPB.
