Schedule
Day 1: Leave Administration
The first day of course covers various types of leave that HR practitioners are called on to deal with as questions arise regarding employee attendance and absence issues. The session will cover common types of leave such as annual leave, sick leave, Leave Without Pay, and leave transfer, with a particular emphasis on administering sick leave, obtaining acceptable medical certification, and controlling abuse. Other types of absence, such as absence under Workers’ Compensation, court leave, and military leave will also be included. Relevant MSPB decisions concerning use of the various types of leave will be reviewed. The final session of the course will cover actions tied to excessive absence, inability to perform, and other attendance-related adverse action issues.
Day 2: Family Medical Leave Act (FMLA) Law and Policy
The second day of the course covers the issues that a practitioner needs to know to properly administer FMLA for Federal employees and to advise regarding personnel actions that implicate FMLA. The course covers the basics of eligibility and notice requirements, to the definition of serious health condition and how that has been interpreted by the MSPB. Requirements for medical certification are reviewed in detail. The course examines the use of intermittent leave under FMLA. Substitution of paid leave for FMLA is covered as well as use of Paid Parental Leave for birth and adoption. The final segment of the course reviews a variety of MSPB cases which involved discipline connected with FMLA.
